SONCAP and used engines in Nigeria: check the goods before claiming exemption

Do not treat “used engine” as a blanket guarantee of SONCAP exemption. Nigeria’s Standards Organisation distinguishes used goods from refurbished or re-engineered commercial articles, and exemption from offshore certification does not remove every regulatory obligation. Get a written determination for the goods you actually intend to import.

What SON’s published guidance says

The SONCAP FAQ lists used products other than automobiles among offshore-scheme exemptions, while stating that refurbished and re-engineered commercial articles must process an Import Permit. It also explains that offshore exemption does not necessarily mean an article falls outside SON regulation and discusses certification for commercial resale goods. These distinctions make the actual condition, description and intended use important.

Send your invoice description and supporting photos to SON or the relevant appointed provider through your Nigerian agent. Ask for the applicable certification or permit route and the document needed for the intended transaction. Do not use the supplier’s marketing grade as evidence of a regulatory exemption.

Classify the purchasing scenario first

Questions to resolve with SON and your Nigerian agent
Proposed goodsIssue to confirm before shipping
Used standalone enginesWhether the published used-goods provision applies to the exact shipment and what SON documentation remains required
Refurbished / re-engineered enginesThe Import Permit route and any additional requirements
New engines or new replacement componentsWhether the goods are regulated and require product / shipment certification
Mixed new, used and refurbished goodsThe correct treatment of each line; do not assume one exemption covers the whole container

Keep the descriptions consistent. If a unit has been rebuilt, do not describe it as untouched used stock to seek a different treatment. If the batch includes separate starters, turbochargers or gearboxes, list them clearly for classification and scope review.

Separate HS classification from conformity status

The WCO Harmonized System distinguishes spark-ignition engines under heading 8407, compression-ignition engines under 8408 and relevant engine parts under 8409. The national subheading depends on the actual goods. A heading alone does not establish a SONCAP exemption, final duty rate or import permission.

Ask your agent to confirm the Nigerian classification and description for each line, then confirm the applicable SON route separately. Retain the written responses with the pro forma invoice and selected-unit records. This helps avoid conflicting explanations between your supplier, bank, inspection provider and clearing agent.

Prepare the bank and clearance file before dispatch

Ask your Nigerian bank and licensed agent to confirm the Form M and pre-arrival assessment requirements for the proposed import, along with required supporting documents. SON’s FAQ refers to PAAR-related permit processing; coordinate the sequence with your agent instead of waiting until the cargo reaches the port. Use the Nigeria Trade Portal and official agency instructions for the transaction.

  • Verify importer identity and the bank’s required registration details.
  • Reconcile the pro forma invoice, goods descriptions, quantities and values.
  • Obtain the written SON scope decision and any required certificates or permit.
  • Check the commercial invoice, packing list and bill-of-lading draft with the agent.
  • Agree who monitors the bank, inspection and customs milestones.

Nigeria compliance questions

Does “Grade A” mean SON-approved?

No. It is a supply-condition description. Only the applicable official process establishes regulatory status.

Should I book freight before confirming the exemption?

Resolve the certification or permit route first. A missing document can create avoidable costs after loading, even when the engines themselves match your buying list.
